A Procuradoria-Geral de Justiça
arquivou investigação contra o ex-governador de São Paulo José Serra
(2007/2010), do PSDB, por suposto envolvimento com o cartel
metroferroviário. Para a cúpula do Ministério Público Estadual, o tucano
não teve participação em conluio para que a CAF fosse
vencedora de concorrência da CPTM destinada à compra e reforma de trens no âmbito do Projeto Boa
Viagem.
“Passados mais de cinco anos desde a instauração do inquérito civil
pela Promotoria de Justiça do Patrimônio Público e Social não foram até o
momento identificados indícios de envolvimento do ex-governador José
Serra na prática de atos de improbidade administrativa relacionados ao
Projeto Boa Viagem”, cravou, em despacho de 7 páginas, o
procurador-geral Márcio Fernando Elias Rosa.
Para Elias Rosa, essa constatação “torna ilógico o prosseguimento do
feito” sob sua responsabilidade, “ressalvada a hipótese de surgimento de
novas provas que situem os fatos na órbita de apreciação do
Procurador-Geral de Justiça”.
A promoção de arquivamento do inquérito civil 648/08 foi encaminhada
na semana passada ao Conselho Superior do Ministério Público, colegiado
da instituição que tem poderes para homologar ou rejeitar a medida. O
Conselho é formado por onze integrantes, sob presidência do chefe do
Ministério Público.
O caso chegou às mãos do procurador geral em fevereiro de 2014 a
partir de representação da Promotoria de Defesa do Patrimônio apontando
“indícios” da participação de Serra no conluio que, segundo a
multinacional alemã Siemens, predominou em São Paulo no período entre
1998 e 2008. Por meio de acordo de leniência firmado em maio de 2013 com
o Cade, órgão antitruste
do governo federal, a empresa citou cinco grandes projetos da CPTM e do
Metrô. Um deles, o Boa Viagem.
A Lei Orgânica do Ministério Público paulista prevê que cabe
exclusivamente ao procurador-geral investigar ex-governador e governador
nos casos de improbidade.
A Promotoria amparou sua petição ao procurador-geral no depoimento do
ex-diretor da Siemens Nelson Branco Marchetti, em novembro de 2013, à
Polícia Federal. O executivo é um dos seis lenientes que subscrevem o
pacto da Siemens com o Cade. Ele afirmou ter se reunido com o então
governador em 2008 em uma feira na Holanda.
Segundo Marchetti, o tucano lhe disse que, caso a Siemens conseguisse
na Justiça desclassificar a empresa espanhola CAF em uma licitação de
compra de trens da CPTM, o governo iria cancelar a concorrência porque o
preço da multinacional alemã era 15% maior. “No edital havia a
exigência de um capital social integralizado que a CAF não possuía.
Mesmo assim, o então governador (José Serra) e seus secretários fizeram
de tudo para defender a CAF”, afirmou o executivo.
Para o procurador-geral, no entanto, o relato do ex-diretor da
Siemens “longe de levantar suspeita contra o ex-governador, revela, ao
contrário, a justa preocupação do chefe do Executivo em relação aos
prejuízos que poderiam advir ao Estado caso a proposta vencedora do
certame, apresentada pela empresa CAF, fosse desqualificada em virtude
de medidas judiciais intentadas pela Siemens”.
Elias Rosa alerta que os fatos mencionados pelo executivo ocorreram
entre os meses de fevereiro de 2007 e dezembro de 2008, ao passo que os
dez contratos relativos ao Projeto Boa Viagem – alvos do inquérito civil
648/08 – foram todos firmados em 2005, “época em que José Serra não era
governador de São Paulo”. O mandato do tucano iniciou-se em janeiro de
2007 e findou em 2 de abril de 2010.
A investigação já havia sido arquivada pela Promotoria de Justiça de
Defesa do Patrimônio, decisão homologada pelo Conselho Superior em junho
de 2010. “Vale lembrar que os fundamentos do arquivamento promovido
pela Promotoria do Patrimônio consistiram, em suma, na ausência de prova
de ocorrência de atos ilícitos na licitação e no contrato”, destaca
Elias Rosa. “Não se cogitou, sequer em tese, a participação do
governador em atos de corrupção.”
Em fevereiro de 2014, a Promotoria pediu ao Supremo Tribunal Federal
cópia em mídia digital do inquérito 3815, aberto originalmente pela
Polícia Federal para investigar suposta prática de corrupção envolvendo
agentes públicos e dirigentes de multinacionais em procedimentos
licitatórios e contratos da área de transporte de massa em São Paulo.
O procurador-geral assinala que os autos chegaram às suas mãos sob o
argumento de que fatos novos evidenciados no inquérito 3815 do STF
“revelariam indícios de envolvimento do ex-governador José Serra na
prática de atos de corrupção em licitações e contratos do sistema
metroferroviário de São Paulo”.
Ao decretar o arquivamento da investigação, o chefe do Ministério
Público também encontra suporte na ordem do ministro Marco Aurélio
Mello, do Supremo Tribunal Federal, que separou os autos da investigação
sobre o cartel, mantendo sob a tutela da Corte apenas a parte relativa
àqueles que detêm prerrogativa de foro, no caso, os deputados federais
Rodrigo Garcia e José Aníbal. “A recente decisão não fez referência alguma ao ex-governador José Serra.”
